Mild traumatic brain injury (MTBI) is an unfortunate consequence of many car accidents. Often times people who are involved in low impact collisions or minor accidents have a headache following the accident which they think will just go away. Unfortunately, often times the headache will continue and will turn into a chronic headache or even a migraine headache. These injuries are related to a mild traumatic brain injury (MTBI) and caused by these car accidents.
Mr. Colombo recently tried an MTBI case in Morgantown. This involved a negligent driver who, without explanation, crossed the center line and struck Mr. Colombo’s client virtually head-on. The client developed a low grade headache following the accident and continued to have chronic headaches with occasional migraine headaches following the accident. The client’s treating neurologist testified that the client suffered a mild traumatic brain injury as a result of the automobile accident and the headaches were likely permanent.
The Defendant’s insurance carrier was GEICO. They made a nominal settlement offer prior to trial. After 3 days of trial and just before closing argument GEICO offered their policy limits which were 6 figures and the client’s underinsurance carrier, Liberty Mutual, also offered their policy limits to settle the case.
